Málaga 24h TV – La Audiencia devuelve al instructor la causa por violación de Pamplona

La Audiencia Provincial de Navarra ha anulado el auto por el que el juez dio por finalizada la instrucción de la supuesta violación grupal de una joven de 18 años el pasado 7 de julio en Pamplona al entender que se ha causado «indefensión» a los cinco jóvenes de Sevilla, entre ellos un guardia civil, que han sido procesados y encarcelados provisionalmente por estos hechos.

En un auto fechado el día 8 de noviembre, al que ha tenido acceso Europa Press, la Sección Segunda de la Audiencia Provincial de Navarra acuerda la nulidad del auto de 17 de octubre por el que el juez de Instrucción número 4 de Pamplona declaraba la terminación del sumario al considerar que se habían practicado todas las diligencias pertinentes para averiguar los hechos.

Al hilo de ello, el tribunal asevera que, pese al dictado del auto de 17 de octubre y la efectiva remisión de la causa a la Audiencia, el instructor, ‘de facto’, «ha continuado generando actuaciones, resolviendo recursos que pendían al momento de declarar la terminación y, a la par, denegando la petición de diligencias interesadas por las partes bajo el argumento de que el sumario estaba concluido».
