The Court of Instruction number 3 of Santiago de Compostela has cited for March 22 as being investigated the Director of Security in the Circulation of ADIF, Andrés María Cortabitarte López, as presumed responsible for serious recklessness of 80 homicide crimes and 150 of Injuries in the Alvia crash on the Angrois curve last July 24, 2013, three kilometers from Santiago. The judge maintains that he was warned of the dangers of the curve where the accident occurred and that he kept the situation doing nothing.

So far, the only investigated was the machinist, Jose Garzón Amo, but the judge adds that the fault of the tragedy is also attributable to Cortabitarte. He was informed that in that curve the train could derail if the engineer got off track, as it happened, and the train entered it at more than 80 kilometers per hour (in fact, it doubled). That is to say, besides the machinist, in a train of high speed, the person in charge of Security of ADIF had to establish additional signals that covered any human fault in a convoy that that day carried almost 220 passengers.
