Audiencia, primera sentencia sobre cláusulas suelo que sigue doctrina europea – Málaga 24h TV

La Audiencia Provincial de Málaga ha dictado la primera sentencia que incorpora la doctrina dictada recientemente por el Tribunal de Justicia de la Unión Europea y el Tribunal Supremo sobre la retroactividad total de la devolución de cantidades en casos de cláusulas suelo que sean declaradas abusivas. De este modo, el tribunal malagueño rechaza un recurso de apelación presentado por Cajamar y confirma la condena a la devolución íntegra de las cantidades cobradas de más, desde el inicio de la hipoteca a tres clientes: 8.221,92 euros, 7.465,05 euros y 5.816,58 euros respectivamente.
El motivo por el que los tres afectados están agrupados en una misma demanda es que compraron su vivienda en la misma promoción y se subrogaron a la hipoteca de la promotora, que era con Cajamar. Por tanto tenían «idénticas condiciones» en sus préstamos, según publica Diario Sur.
Con esta sentencia, la Audiencia en realidad no hace sino restablecer su criterio inicial respecto a la procedencia de la retroactividad total. En efecto, el tribunal malagueño fue pionero en dar la razón a los consumidores que exigían la devolución del dinero pagado de más a lo largo de todo el préstamo. Una postura que compartía con los juzgados mercantiles malagueños y que después se vio obligada a modificar como consecuencia de la doctrina del Tribunal Supremo, que limitó la retroactividad a mayo de 2013.

The Provincial Court of Málaga has issued the first sentence incorporating the doctrine recently issued by the Court of Justice of the European Union and the Supreme Court on the total retroactivity of the return of amounts in cases of land clauses that are declared abusive. Thus, the Malaga court rejects an appeal filed by Cajamar and confirms the condemnation of the full refund of the amounts collected more, from the beginning of the mortgage to three clients: 8,221.92 euros, 7,465.05 euros and 5,816.58 euros respectively.
The reason why the three affected are grouped in a same lawsuit is that they bought their home in the same promotion and were subrogated to the mortgage of the promoter, which was with Cajamar. Therefore, they had «identical conditions» in their loans, according to Diario Sur.
With this ruling, the Audiencia actually only re-establishes its initial criterion regarding the provenance of total retroactivity. In fact, the Malaga court was a pioneer in giving the reason to the consumers who demanded the refund of the money paid more during the whole loan. A position that shared with the mercantile courts in Malaga and was then forced to modify as a result of the doctrine of the Supreme Court, which limited retroactivity to May 2013.
