La promotora del Algarrobico vuelve a pedir al Ayuntamiento que le pague 1,7 millones por el suelo.
Y es que considera que este montante económico debe ser restituido, así como los demás gastos, intereses y daños y perjuicios sufridos ya que, en caso contrario, se produciría un enriquecimiento injusto a favor del consistorio.
Recordemos que el Ayuntamiento comunicó al Tribunal Superior de Justicia de Andalucía que dio cumplimiento a la sentencia que le ordena cambiar el suelo de El Algarrobico de urbanizable a espacio protegido en su planeamiento urbanístico.
El consistorio argumentó ante el Alto Tribunal andaluz que no podía declarar nula la licencia de obras pero remarca que esta es, ahora mismo, inejecutable debido a que ha cambiado radicalmente la normativa vigente en 2003 conforme a la que se tramitó.
