Málaga 24h TV – El TC declara nulas las tasas judiciales impuestas por Gallardón

El Tribunal Constitucional ha declarado nulas por inconstitucionales las tasas judiciales impuestas a las personas jurídicas impulsadas en su momento por el exministro de Justicia Alberto Ruiz-Gallardón.

En una sentencia adoptada por unanimidad, el tribunal ha estimado parcialmente el recurso presentado por el PSOE y declara inconstitucionales las tasas aprobadas en noviembre de 2012. La normativa contó desde el primer momento con el rechazo de profesionales, sindicatos y consumidores que llegaron a unirse en la Plataforma ‘Justicia para Todos’.

Tras un informe crítico de la Oficina del Defensor del Pueblo, la norma se sometió a una primera modificación para rebajar ciertas cuantías y exonerar directamente del pago de las mismas en determinados trámites como separaciones y divorcios de mutuo acuerdo. El actual ministro de Justicia, Rafael Catalá, fue más allá y eliminó mediante Real-Decreto las tasas judiciales para personas físicas si bien mantuvo el tributo a las pymes.

English: The Constitutional Court has declared unconstitutional void by court fees imposed on legal persons driven at the time by the former Minister of Justice Alberto Ruiz-Gallardon.

In a statement adopted unanimously, the court partially upheld the appeal filed by the PSOE and declares unconstitutional the rates approved in November 2012. The legislation had from the outset with the rejection of professionals, unions and consumers who came to join in Platform ‘Justice for All’.

Following a critical report of the Office of the Ombudsman, the standard underwent a first amendment to reduce certain amounts and payment directly exonerate them in certain procedures such as separation and divorce by mutual agreement. The current Justice Minister Rafael Catala, went further and removed by Royal Decree-court fees for individuals but maintained the tribute to SMEs.
